PROTECTION OF PERSONAL DATA

We, the Association Center for the Study of Democracy, hereinafter referred to as ACSD, located in Cluj-Napoca, str. Câmpului nr. 242, ap. 6, 400686, with fiscal code 31226300, bank account IBAN: RO32BTRLRONCRT00R5050301, opened at Banca Transilvania, represented by president Jiglău George, through our sub-brand, Research Center for Civil Society , have taken technical and organizational measures to protect personal data against loss, modification, or to eliminate the risks of unauthorized access. Thus, the personal data processed by us are in accordance with the legal provisions on the protection of personal data and Regulation EU 2016/679 (hereinafter GDPR), as it is transposed into national legislation.
Type of personal data – the personal data that will be processed by Research Center for Civil Society are such as: name, email, phone number, address. Regarding access to our site www.civicresearch.center, the collection of these data is done only by their explicit transmission by the user, by filling out the contact/subscription form to our newsletter, where the user gives their explicit consent for the collection of the transmitted data. Another way of transmitting personal data is when the user purchases a product available on our website. If the user wishes to exercise their rights or any information regarding their rights under the GDPR, they will contact The Civic Research Center at the email address [email protected] to which we will respond within 72 hours.
Data collection methods: filling out a contact form regarding the request for information or subscription to the newsletter, respectively by purchasing the products sold by our center.
DEFINITIONS:
Personal data – any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
Data controller – means the person who transfers personal data.
Technical and organizational security measures – means measures designed to protect personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access, especially when processing involves data transmission over a network, as well as against any other form of processing.
Categories of processed data – personal data (first name, last name, address, phone number, email address, etc.) are processed by us only if these data are entered by the interested person in the fields created on our site (e.g., the section regarding the request for information or subscription to the newsletter).
Processing of personal data – means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
II. PERSONAL DATA WE PROCESS
We use your personal data to benefit from the advantages and information resulting from our activities and projects, as follows:
a. Data for the newsletter service:
We process your data consisting of name and email address for subscribing to our newsletter.
Upon accessing the website, the option regarding subscription to our newsletter is visible, in which case, to subscribe, you need to click the “Subscribe to Newsletter” button.
Following this subscription agreement step, you are asked to enter a series of data about yourself that will allow us to send you relevant offers and information, as well as to express your consent regarding how you want us to communicate with you.
Through this subscription, you will benefit from direct marketing actions specific to our activity segment and through which we will keep you informed about our products, services, and campaigns, complying with the legal provisions in force. Similarly, by subscribing to our newsletter, the user expressly accepts that the notifications sent to them reach their inbox through third parties, such as Survey Monkey/ Mailchimp/ Brevo, third parties that have their own privacy policy, which we have ensured is in accordance with this privacy policy.
The use of the data ceases as soon as you unsubscribe from the newsletter service. You can unsubscribe at any time and free of charge from the newsletter service by: checking the “Unsubscribe” option within the newsletter or sending an email to [email protected] explicitly requesting the unsubscription or by accessing the link that will be provided for unsubscription on our website.
b. Data for requesting information/communication of information
By filling out the contact forms intended for potential collaborators or partners, you provide us with access to your contact data, which we will use to respond to requests and questions addressed.
Some contact forms and types of communications will be sent to our users through third-party platforms such as Google Forms, Survey Monkey, Brevo, and others. In this case, our cente ensures that these third-party platforms comply with legal requirements regarding the collection, storage, use, and deletion of personal data.
c. Social network plugins and the use of cookies
Our website uses “plugins” from social network operators (e.g.: www.facebook.com). All social network plugins on our website are clearly and distinctly marked. Through these plugins, our website does not collect/store personal data of site users. In addition to our users, according to the way social networks operate, there is a possibility that the virtual friends of our users will view our page as a result of liking our web page. Regarding the use of Cookies (the terminology includes “Internet Cookie”, “browser cookie”, “HTTP cookie” or simply “cookie”), we specify that these are files or information that can be stored on your computer or mobile devices with Internet access (smartphone or tablet) when you access the Internet. The cookie is installed by the request issued by a web-server to a browser (e.g.: Internet Explorer, Chrome) and cannot access the information on the user’s computer/mobile device. We mention that this technology does not contain software programs, viruses or spyware. We use cookies to make the site easier to use and to better adapt it, through the information provided, to your interests and needs. Cookies are also used to increase the speed of your future activities and experiences on our site.
d. Purchase of membership or products that the Research Center for Civil Society sells
Through these types of purchases, you provide us with your personal data for performing the necessary accounting/fiscal operations (invoice/fiscal receipt). The collected data are name, first name, address, phone number. Your payment is secured through the third-party service (e.g., Stripe/ Netopia Payments/ Euplatesc.ro), which under the contract with the Center guarantees the security of your data.
III. PURPOSE OF DATA PROCESSING
In general, all collected information is used for the intended purpose for which you sent it to us, mentioned at the time of collection or in the privacy policy. We may use your personal data for one of the following purposes:
- we use your contact data to respond to your requests communicated either through the contact form or directly using our email or postal address;
- we use the email address you provided to receive commercial information such as newsletters, news, various communications about our projects, etc., if you have given your consent in this regard;
- we use the information collected through cookies, pixels, or plug-ins to provide you with an optimized experience when using our site;
- we use the information collected to issue invoices, respectively for you to have the possibility to purchase our products/services.
If you choose not to provide any personal information when requested, you may not be able to participate in certain activities and personalized features on our sites and may have limited access to the information provided through our site. For example, if you refuse to share your email address, you will not be able to receive any newsletters. However, to simply browse our site and learn more about us and our activities, you do not need to provide us with any personal information.
IV. DATA TRANSFER
We guarantee that the data will not be sold or rented to other individuals or legal entities, so that they can be used by other companies, other collaborators or partners, without your consent. However, we may communicate your data to third parties to ensure that you benefit from our services, such as service providers that ensure the operation of the website, marketing agencies that would ensure the communication of the newsletter, public authorities or institutions to meet legal obligations, the third-party payment operation service, etc.
V. RIGHTS REGARDING THE PROCESSING OF PROVIDED PERSONAL DATA
According to the GDPR, as a data subject, you benefit from a set of rights, respectively:
a. Right to information and access to personal data: the right to obtain confirmation of whether or not personal data concerning you are being processed and, if so, access to the respective data.
b. Right to rectification: the right to request and obtain from the Controller, without undue delay, the rectification of inaccurate personal data concerning you and/or to have incomplete personal data completed.
c. Right to erasure of data (“right to be forgotten”): the right to obtain the erasure of personal data concerning you, without undue delay, where certain grounds listed in the GDPR apply.
d. Right to restriction of processing: the right to obtain restriction of processing in certain cases.
e. Right to data portability: the right to receive the personal data concerning you and to transmit those data to another controller.
f. Right to object: the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you, in accordance with the GDPR.
g. Right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.
h. Right to lodge a complaint with the National Supervisory Authority for Personal Data Processing (ANSPDCP) if you consider that your data have not been processed in accordance with legal provisions, with which you can contact using the following contact details:
